Terms of Service

These terms are an agreement between you and Core Access Technologies (“we”, “us”) for your use of HitCanvas at hitcanvas.com and app.hitcanvas.com, including its API. By creating an account or using the service you agree to them. If you use HitCanvas for a company, you agree on its behalf. Our Privacy Policy describes how we handle data and is part of these terms.
1. Accounts and workspaces
You need an account to use HitCanvas, and you must be at least 13 years old, or the age of digital consent where you live if that is higher. Give us an email address you control, keep your password and API keys secret, and tell us if you think someone else has them. You are responsible for what is done with your account and with keys created in your workspace. Everyone in a workspace shares its thumbnails, brand kits, keys and monthly allowance; the owner decides who is in it.
2. Acceptable use
You agree not to use HitCanvas to:
- upload a photo of any person, yourself aside, unless you have the right to use that photo and that person’s permission to appear in your thumbnail. This covers athletes, guests, public figures and anyone else your video is about. You confirm it with a tick box each time you upload, and you are responsible for it being true;
- make an image that puts a real person in a false, sexual, defamatory or harassing light, or that suggests they endorse you, your channel or a product when they do not;
- make content that is illegal, that sexualises minors, that promotes violence or hatred against people, or that infringes someone else’s copyright, trademark or right of publicity;
- mislead viewers in ways YouTube’s own policies prohibit, or impersonate another channel or brand;
- copy a specific thumbnail belonging to someone else. The niche analysis describes patterns so that you can make something original;
- get around usage limits, create accounts to multiply free allowances, resell access without our agreement, probe or disrupt the service, or scrape it;
- break the terms of the model providers or of YouTube, described below.
We may remove content, limit use or suspend an account that breaks these rules.
3. Your content and what you make
What you put in (descriptions, headlines, photos, logos, fonts) stays yours. You give us permission to process it, and to pass it to the providers named in our Privacy Policy, only to provide the service to you.
As between you and us, the thumbnails you make with HitCanvas are yours, and we claim no ownership of them. You may use them commercially, including on YouTube. Three cautions. Images are made by third-party AI models, and your rights in them are also subject to those providers’ terms, including OpenAI’s terms and usage policies and those of Black Forest Labs. The law on copyright in AI-generated images is unsettled and differs between countries, so we cannot promise that an image is protected by copyright or that you hold it exclusively. And AI models can produce similar images for different people, so another user may receive something that resembles yours.
You are responsible for making sure that what you publish is lawful, accurate and yours to publish.
4. YouTube data
HitCanvas uses YouTube API Services to retrieve public video and channel data for its niche analysis. By using HitCanvas you agree to be bound by the YouTube Terms of Service. Google’s handling of data is described in the Google Privacy Policy. The figures we show, such as views, subscribers and search position, are cached public data that may be out of date. They are not official YouTube analytics, they are not click-through rates, and they are not endorsed by YouTube or Google. HitCanvas is not affiliated with YouTube or Google. If you connect a YouTube channel, you confirm that you are entitled to grant access to it; the access is read-only, and you can withdraw it at any time.
5. Plans, limits and billing
Each plan includes a monthly allowance of image generations, niche analyses and thumbnail concepts. Allowances reset on the first of each month (UTC) and do not roll over. A call that fails is not counted. We may change what a plan includes for future months, and we will tell you before a change that reduces a paid plan takes effect.
The free plan costs nothing and needs no card. Paid plans, when they are on sale, are billed in advance, monthly or yearly, in US dollars, by our payment processor, and renew automatically until you cancel. You can cancel at any time and keep the plan until the end of the period you have paid for. Except where the law requires otherwise, payments are not refundable. Prices may change; a new price applies from your next renewal, and we will tell you first. You are responsible for any taxes that apply.
6. The service
We work to keep HitCanvas available and correct, and we change it often. Features may be added, changed or removed. The service depends on third parties, including AI model providers and YouTube, whose availability and rules are outside our control, and a provider may refuse a request under its own safety policies.
7. Disclaimers
HitCanvas is provided “as is” and “as available”. To the fullest extent the law allows, we make no warranties, express or implied, including of merchantability, fitness for a particular purpose and non-infringement. We do not promise any result on YouTube: not views, not clicks, not click-through rate, not subscribers, not revenue. A niche analysis and a review describe what is visible in public data and in your thumbnail; they are not predictions. AI output can be wrong, unexpected or offensive, and you should look at everything before you publish it.
8. Limit of liability
To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill. Our total liability for all claims about the service is limited to the greater of the amount you paid us in the twelve months before the claim arose and one hundred US dollars. Some places do not allow these limits, so parts of this section may not apply to you.
9. If someone makes a claim because of your use
If a third party brings a claim against us because of content you uploaded or published, or because you broke these terms or the law, you agree to cover our reasonable costs and losses from that claim.
10. Ending things
You can stop using HitCanvas at any time and ask us to delete your account by emailing support@hitcanvas.com. We may suspend or end your access if you break these terms, if we must do so by law, or if we stop offering the service, in which case we will give reasonable notice where we can so that you can download your work. Sections that by their nature should survive, including ownership, disclaimers and limits of liability, continue after your account ends.
11. Governing law
These terms are governed by the laws of the United States and of the state in which Core Access Technologies is organized, without regard to conflict-of-law rules, and disputes will be heard in the state or federal courts located there, unless the law where you live gives you the right to bring a claim at home. Nothing here removes consumer rights that cannot be waived.
12. Changes to these terms
We may update these terms. We will change the date at the top, and for a change that matters we will email the address on your account before it takes effect. If you keep using HitCanvas after that, you accept the new terms.
